In fiscal year 2007, the Equal Employment Opportunity Commission (EEOC) received 82,792 private sector discrimination charges (some charges alleged more than one violation):

  • Race discrimination - 30,510 charges filed
  • Sex/Gender discrimination - 24,826 charges filed
  • Age discrimination - 19,103 charges filed
  • Disability discrimination - 17,734 charges filed
  • Pregnancy discrimination - 5,587 charges filed
  • National origin discrimination - 9,369 charges filed
  • Religious discrimination - 2,880 charges filed
  • Sexual harassment - 12,510 charges filed (16% filed by men)
  • Retaliation - 26,663 charges filed

The EEOC recovered $345,000,000 in total monetary relief for the charge parties ($290,000,000 through administrative enforcement and $55,000,000 through EEOC litigation).

 

Employee Benefit Plans

The Employee Benefits Security Administration (EBSA) is responsible for ensuring the integrity of the private employee benefit plan system in the U.S. For fiscal year 2007, the EBSA:

  • Closed 3,236 civil investigations, with almost 75% resulting in monetary results or other corrective action
  • Referred 164 civil cases for litigation to the Solicitor of Labor
  • Closed 188 criminal investigations, which led to the indictment of 115 individuals (plan officials, corporate officers, and service providers)
  • Handled 161,062 inquiries made on behalf of workers and their families through their informal complaint resolution process, resulting in $96,000,000 in benefits recovered

The EBSA’s total monetary results for fiscal year 2007 were approximately $1,500,000,000 recovered on behalf of plan participants ($719,700,000 for prohibited transactions correction and plan asset protection, $642,100,000 for plan asset restoration and participant benefit recovery, and $130,000,000 through the Voluntary Fiduciary Correction Program).
